The following General Terms and Conditions
apply within the framework of contracts concluded between M A T A T E C - VASAATHI and the respective clients:

3. 1 Notes on the
storage of the contract text
Contract text is stored on our internal systems.
Contract text stored by us is no longer freely accessible after completion of the order.

4. Confirmation of an order
As soon as you have placed your order you will receive an order confirmation from us ( - if we can take over the order ) .
A contract is therefore only concluded with the dispatch of an order or order confirmation.
4. a In the case of an M A T A T E C - VASAATHI - Transformation , a pre-payment of at least half of the total order price is usually levied.
The order is then carried out and executed as soon as possible – or at the favourable dates corresponding to VAASTU – VASAATHI – as soon as possible.
5. Delivery conditions
In the hardware product prices indicated by us, the currently valid sales and value added taxes
are already included !!!
- Any shipping costs such as transport insurance or any international import taxes are extra additive.
M A T A T E C “Thee Source ”– Aggregates are usually delivered in person (- as part of the other work required on site and as agreed with You ) .
Since M A T A
T E C “Thee Source ”– Aggregates are manufactured over a longer cycle and therefore ( - especially in the case of the larger units ) are not always in stock – or are also manufactured according to the customer’s request, – with our order acceptance of your
order (- after agreement with You) usually a partial payment or partial advance payment occurs.
Until full payment for a product, goods remain in the possession and ownership of M A T A T E C .
6. Delivery to P. O. Box address
Delivery of your order to a PO Box address is not possible.
7. Invoice
You will receive an invoice either together with the delivery of the goods or
after arrangement extra – u. o. by email possibly also as a total invoice together with any performed services.
8. Payment by prepayment
We will give you our bank details in separate e-mail or together with our
order acceptance and deliver the goods or service to You after receipt of payment or after arrangement.
We have no control over how quickly your payment is credited to our account by the banks. This may take up to 3 business days. As soon as Your payment is received on our account, your order will be
processed by us and prepared for dispatch or handover as soon as possible.
Your contact and connection data provided to us are used exclusively for internal order processing. Your data will definitely not be passed on to uninvolved external third parties.
We also do not send advertisements or newsletters by post or email !!!
10. Transport damage
If goods are delivered with obvious transport damage, please report such
defects immediately to the courier and contact us immediately.
Failure to make a complaint or contact has no consequences whatsoever for your legal claims and their enforcement, in particular your warranty rights.
However, they help us to be able to assert our own claims against the carrier or any transport insurance.
11. Warranty and Warranties
The statutory right to liability for defects applies.
11.1 If the customer is a businessman, the risk of accidental loss and accidental deterioration of the goods shall pass to the customer upon the handover, in the case of dispatch purchase with the delivery of the goods
to the freight forwarder, the carrier or the person otherwise designated to carry out the shipment.
11.2 If the customer is a consumer, the risk of accidental loss and accidental deterioration of the goods sold
shall not pass until the goods are handed over to the customer, even in the case of dispatch.
The handover is the same if the customer is in default of acceptance.

12. Liabilities
12. 1 The provider is only liable for damages if he or one of his vicarious agents has breached an essential
contractual obligation or the damage is due to gross negligence – or wilful intent of the provider –
or one of his vicarious agents.
An essential contractual obligation is an obligation the fulfilment of which enables the proper execution
of the contract in the first place and on which the customer can regularly rely.
12.2 If the culpable breach of an essential contractual obligation is not caused by gross negligence
or intent, the liability of the provider is limited to the damage that was reasonably foreseeable for
the provider at the time of the conclusion of the contract.
12.3 The above liability regulations apply to contractual as well as non-contractual claims. Liability is
unaffected due to mandatory statutory provisions, guaranteed properties, assumed warranties
as well as for damages resulting from injury to life, body or health.
13. Dispute settlement
The European Commission publishes under https://ec.europa.eu/consumers/odr/ in accordance with Art. 14 para. 1 ODR-VO Regulation provides a platform for online dispute resolution (ODR).
We are not obliged to participate in a dispute settlement procedure before a consumer arbitration body (VSBG) - and are therefore we are rejecting it .
14. Instruction of revocation Right of revocation
You have the right to revoke a purchase contract for our products within fourteen days without giving reasons.
The cancellation period is fourteen days from the day on which you or a third party named by
you, who is not the carrier, have taken possession of the goods.
To exercise your right of withdrawal, you must contact us –

- inform by means of a clear statement ( - a letter sent by post plus e-mail )
of your decision to revoke a purchase contract.
You can use the attached model withdrawal form, which is not mandatory.
In order to comply with the revocation period, it is sufficient that you send the notification about the exercise of the right of revocation before the expiry of the revocation period.
14.1 Reimbursement of your payments
As soon as your return has arrived properly and undamaged, the goods will be
checked with us and possibly clarified with you which amount is to be refunded. You will receive the refund within 14 days. For this we need a valid bank account from you.
If you revoke a purchase contract, we shall reimburse you immediately and at the latest within fourteen days from the date of notification for all payments received from you, including delivery costs
( - with the exception of the additional costs arising from the fact that you have chosen a method of
delivery other than the cheapest standard delivery offered by us ) about your revocation of this
contract has been received by us.
For this refund, we use the same means of payment that you used for the original transaction, unless otherwise
expressly agreed with you; – under no circumstances will you be charged any fees for this refund. We may refuse the refund until we have received the goods back or until you have provided proof that
you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any event not later than fourteen days from the day on which you inform us of the cancellation of this contract.
The deadline is met if you send the goods before the expiry of the fourteen-day period.
Returns to us must be made free, i. e. the postage costs are to be borne by you.
You only have to pay for any loss in value of the goods if this loss in value is due to handling them that is not necessary to check the nature, characteristics and functioning of the
goods.
14.2 Model withdrawal form

14.3 Refund Exceptions

the M A T A T E C “Thee SOURCE”– Aggregates ,
- or as part of
M A T A T E C – VASAATHI , -
work already performed or service work, – as well as any special individual work carried out
on behalf of a customer or other specially designed special work will no longer be refunded.
15. Address data:
Your address data and profile data are safe with us. Your data will only be used for the
complete processing
of your order. You will also not receive advertising emails or other mail from us.
16. Changes to an order:
A change of your order is only possible with direct agreement ( - a possible request then please by
email
or telephone to us ).
17. Data protection:
Further information can also be found on our imprint page in the upper area
under Privacy policy.
The data you provide in the context of an order or an order receipt will be used to fulfill and process your order. A transfer of your data takes place in the case of deliveries by post or forwarding
company, – to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of the goods. In order to process payments, we may pass on your payment data to our
bank. Your data will not be passed on to other third parties, in particular for advertising purposes.
18. Contacting
If you have contacted us with regard to a possible order or with regard to a
possible order by e-mail, post or telephone, we assume that we will also call You (- for the benefit of common interests and order processing . . . ; – . in case of
closer acquaintance also to exchange congratulations etc. ) may contact by email or .
However, according to the EU-DSG-VO, you have the possibility and the right to revoke this consent to contact us (if it is not absolutely necessary or would be necessary for the agreed processing of
the order) at any time in writing !!!
19. Final provisions
If the Customer is a merchant, a legal person under public law or a special
fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relations between the Customer and the Provider shall be the registered office of the Provider.
However, the provider has the right to sue at the customer’s registered office.
20. Salvadorian clause
Should a paragraph or section mentioned here become legally invalid, the other
paragraphs and paragraphs remain valid and unaffected.
